Request for Proposals (RFP): Marion County is seeking proposals from qualified attorneys who are interested in serving a Marion County Counselor for a one-year period beginning April 1, 2018.

General Scope of Work:
Serve as legal counsel to the Board of County Commissioners and Marion County departments. Work is on an as needed basis and includes but is not limited to:

  • Reviewing and/or drafting contracts/agreements;
  • Attending County Commission meetings on a schedule to be agreed upon by the Board of County Commissioners and the selected Counselor;
  • Occasionally attending other County meetings as needed;
  • Answering legal questions pertaining to all areas of County authority and operations (including but not limited to planning/zoning, jail operations, KOMA/KORA, personnel matters, budget, bond & financial authority, road closings and vacations, policy development, etc.);
  • Negotiating leases, land acquisition, and other agreements on behalf of the County in conjunction with the County Commission;
  • Representing the County when legal claims or litigation are filed against the County and submitting all required responses and filings on behalf of the County;
  • Advising the Board when situations arise that put the County at legal risk;
  • Being readily available and responsive to questions from the County Commission and Department Heads via phone and email;

Additional Scope of Work:

  • Perform work leading up to and culminating in a tax sale of properties with delinquent taxes. (This should be submitted as a separate proposal).

Proposals should include a statement of previous experience with the associated duties of the County Counselor position as well as at least three references for said work.

Proposals should outline the monthly fee being proposed for said services and indicate the number of hours included. Any additional per/hour fee must be stated.

Any known conflicts of interest should be noted (for example - if you represent another jurisdiction within Marion County.)

Proposals for performing duties related to the tax sale shall be listed in a separate section as a flat fee.

All proposals shall be submitted to the Marion County Clerk's Office by 5:00 p.m. on Friday, February 2, 2018. Proposals may be submitted in person, or by mail or electronic means:

Proposals will be reviewed by Board of County Commissioners on Monday, February 5, 2018 at 10:20 a.m.

Marion County reserves the right to refuse any and all bids.

Additional Information:

The Marion County Commission meets most Mondays at 9:00 a.m. and the last working day of every month for payday. Meetings typically last three to six hours. Other special meetings are scheduled as needed.
