After 35 years of Indian Child Welfare Act (ICWA) implementation, the Bureau of Indian Affairs (BIA) has issued new guidelines and is proposing new regulations to guide state courts and child welfare agencies in child welfare proceedings involving American Indian and Alaska Native (AI/AN) children and families. The original ICWA guidelines were published on November 26, 1979, and have remained unchanged since. This CLE will be a review of these new guidelines.

Vivien Olsen has worked as Legal Counsel for the Prairie Band Potawatomi Nation since 2007. Prior to working for the Nation, she was the Inspector General and a staff attorney for the Kansas Juvenile Justice Authority.  For several years Vivien owned and operated a private law office in St. Marys, Kansas. She is past Chair of the Indian Law Section, KBA and a charter member of the Kansas Chapter of the Federal Bar Association and a certified Kansas mediator.
