Unexpired Leases & Executory Contracts in Bankruptcy

One of the more complex aspects of the Bankruptcy Code is the treatment of unexpired leases and executory contracts. In this presentation, the panelists will provide an overall discussion about how different types of leases and contracts are treated in bankruptcy ranging from commercial leases to agricultural farm leases. The panelists will discuss the fundamental aspects of assumption, assignment and rejection and provide some practical considerations for lease negotiations. 



Tom Gilman 

Tom is a 1981 graduate of Washburn University with a BBA in economics and a 1983 graduate of Washburn University School of Law. He began working for Redmond, Redmond, O’Brien & Nazar immediately after graduating from law school and taking the bar exam. He stayed with that firm (or evolutions of that firm) until January 1, 2015, when the firm (Redmond & Nazar, LLP) merged with Hinkle Law Firm LLC. He is currently a member in the Hinkle Law Firm LLC. His practice focuses on all aspects of bankruptcy and general civil litigation.


Eric Johnson

Eric Johnson is a partner at Spencer Fane LLP in Kansas City. He is the co-practice group leader for the Banking and Financial Services Group. His practice involves the representation of secured creditors, trustees, and other interested parties in insolvency related matters. Eric received his undergraduate degree from the University of Northern Iowa, and his law degree from the University of Iowa College of Law. In addition to being a frequent speaker on insolvency related topics, Eric recently concluded his term as the president for the Kansas Bar Association Bankruptcy and Insolvency Section. Eric is also serving on the American Bankruptcy Institute Board of Directors and on the advisory board for the Midwestern Bankruptcy Institute, an annual program jointly sponsored by the ABI and the University of Missouri – Kansas City. Eric is also currently serving as the chair of the Missouri Bar’s Business/Corporate Division. Eric has been listed in The Best Lawyers in America, the Kansas City Business Journal’s  “Best of the Bar” as well as being listed as a Missouri and Kansas Super Lawyer by Super Lawyers. Eric is board-certified in business bankruptcy by the American Board of Certification.
