Deborah L. Hughes, Office of the Disciplinary Administrator, Topeka
Philip R. Michael, Kansas Department of Administration, Topeka
Cheryl Whelan, Office of the Attorney General, Topeka
This presentation will address recent statutory changes to the KORA, and the role of attorneys in advising public bodies and public agencies of their legal obligations pursuant to the KORA and the KOMA.  The relationship between an attorney’s ethical obligations to maintain confidentiality of attorney-client records protected by KRPC 1.6 and the KORA also will be examined.

Deborah L. Hughes, Office of the Disciplinary Administrator, Topeka
Deborah Hughes is a Deputy Disciplinary Administrator with the Office of the Disciplinary Administrator. She is a 1989 graduate of the University of Kansas School of Law.  After law school, she worked in private practice as an associate with the Topeka law firm of Scott, Quinlan & Hecht.  She joined the Shawnee County District Attorney’s Office in 2001, where she was responsible for the office’s appeals and post-conviction cases.  From 2004 through 2012, she worked for the Kansas Supreme Court as the Court’s Special Projects Attorney.  Prior to joining the Disciplinary Administrator’s Office in November 2013, Ms. Hughes worked as an appellate defender with the Kansas Appellate Defender Office.

Philip R. Michael, Kansas Department of Administration, Topeka
Philip Michael is an attorney in the Office of Chief Counsel, Kansas Department of Administration.  His primary duties include serving as the agency KORA custodian and records officer, contract review and drafting, labor relations, advising the Kansas Office of Information Technology Services on legal matters, and serving as the Secretary of Administration’s designee on the State Records Board.  Philip earned his Juris Doctor from Washburn University.  He possesses a Master’s degree in History from Emporia State University and an undergraduate History degree from McPherson College.

Cheryl Whelan, Office of the Attorney General, Topeka
Cheryl Whelan is an Assistant Attorney General and the Director of Open Government Training and Compliance in the office of Kansas Attorney General Derek Schmidt.  Her primary duties include promoting transparency in government through training, education and outreach on the KOMA and the KORA, and serving as the freedom of information officer for the office.  Cheryl also conducts legal reviews of interlocal agreements and easements, and drafts opinions.  Cheryl previously served as the General Counsel for the Kansas State Department of Education and has many years of experience as an attorney with various governmental agencies including the United States Army, the State Fire Marshal’s Office, the Shawnee County District Attorney’s Office, and the Kansas Court of Appeals.  She has given presentations on a variety of topics related to open government laws, governmental law and professionalism.  Cheryl earned both her Juris Doctor and Masters of Public Administration from the University of Kansas.  Her undergraduate degrees in political science and communication studies are from Washburn University.
