This session will address the current status of the law on religious discrimination and accommodation under Title VII.  The impact of the Abercrombie and Fitch Supreme Court case will be reviewed, as well as recent lower court decisions.  Practical advice to give to employer clients will be offered as well.

New white collar exemption regulations under the Fair Labor Standards Act (FLSA) were issued in May and go into effect on December 1.  These regulations affect a significant number of employees who are currently exempt from overtime requirements but may become eligible for overtime under the new rules.   This presentation will discuss the new rules and new salary thresholds, options for compliance, and the impact on both employers and employees.

Presenter Information

Mark A. Buchanan is currently in private practice in Fairway, Kansas. A graduate of the University of Kansas School of Law, he was a shareholder and director of the Popham Law Firm, P.C., where his practice focused on representation of plaintiffs in employment discrimination cases. He was lead counsel in Pace v. Shoney’s, Inc., (No.  93-0207, W.D. Mo.), the first pregnancy discrimination case tried in the United States under the Civil Rights Act of 1991. He represents employees in cases arising under Title VII, state and federal whistleblowing laws, the Age Discrimination in Employment Act, the Equal Pay Act, and Family and Medical Leave Act.  He is the author of “Ex-parte Interviews After Aiken v. Business and Industry Health Group, Inc.,” published in The Journal of the Kansas Bar Association (January, 1996) and has been a frequent lecturer regarding the evolving case law interpreting Model Rule 4.2.

 

Prior to joining private practice, Mr. Christensen practiced with the United States Navy Judge Advocate General's Corps where he served as a legal advisor to an overseas base commander and where he also tried numerous cases. He later served as the Vice President for Litigation, Records Management and Legal Systems for a Fortune 500 diversified financial services company. He is a frequent author and lecturer on topics related to labor relations, employment law, managing litigation and electronic discovery.

  


Michael Kopit focuses his practice on civil defense litigation.  Michael received his Juris Doctor and Certificate in Advocacy from the University of Kansas School of Law in 2012.  During his second year of law school, he served as a student-intern for the Honorable Julie A. Robinson in the United States District Court for the District of Kansas.  He also participated in the Law School’s Legal Aid Clinic providing legal assistance to low-income clients, where he received the W. Ross Hutton award for the best overall performance in the Clinic.  Prior to joining the firm, Michael was with another local defense litigation firm where he regularly defended government entities, corporations, and individuals from civil liability.

 

Alan Rupe is a partner at Lewis Brisbois Bisgaard & Smith, LLC. and managing partner for the firm’s Wichita and Kansas City offices.  He is Vice Chair of the firm’s national Employment and Labor Group.  Mr. Rupe received a B.A. from the University of Kansas and a J.D. from Washburn University. Mr. Rupe is a board-certified trial attorney, certified through the National Board of Trial Advocacy, an “Advocate” member of the American Board of Trial Advocates (ABOTA), and is a member of the Litigation Counsel of America, an invitation-only lawyer honor society representing less than one-half of one percent of American lawyers.   Mr. Rupe has served as President of the KBA's Employment Law Section and chaired the KBA’s CLE Committee.

 

Diane H. Sorensen has been practicing in the area of employment law at Morris, Laing for over 25 years.  A 1984 graduate of the University of Kansas law school, she completed two judicial clerkships (one for the Kansas Supreme Court, and the other for the United States District Court for the District of Kansas) prior to joining the firm in 1988.   Diane’s practice includes litigation of employment matters for both plaintiffs and defendants (from non-compete agreement enforcement to discrimination claims), advising of employer clients on all aspects of employment law, handling of administrative complaints, drafting of employment contracts, conducting on-site investigations, and training supervisory employees.  Diane is a frequent speaker at employment law seminars, and has published numerous articles on employment law topics.  Diane is also involved in alternative dispute resolution.  She is an approved federal mediator and mediates employment law cases, and she recently has been certified as an arbitrator by the American Arbitration Association. 

 

Dave Wing is a partner with Spencer Fane law firm in Kansas City.  He has over 38 years of experience, including clerkships with the 10th Circuit Court of Appeals and with the U.S. District Court of Kansas.  Dave’s practice is focused on solving difficult employment problems for employers in the areas of traditional labor, human resource counseling, and employment litigation.  As part of his practice, he works closely with employers on wage and hour compliance issues, advises on FLSA audits by the U.S. Department of Labor, and defends wage/hour claims at the federal and state level.  Dave received his undergraduate and law degrees from the University of Kansas.  For many years, he has been selected as a SuperLawyer, Best Lawyer and Chambers Leading Lawyer in labor and employment law in Missouri and Kansas.  In addition, he is a Fellow in the prestigious College of Labor and Employment Lawyers.
