The internal investigation is conducted to determine if the conduct actually occurred, its scope and the persons responsible. Through the internal investigation, the organization may identify corrective actions it should undertake. A successful internal investigation follows best practices. This program will discuss recognized best practices for internal investigations. Topics include: When is it appropriate to launch an internal investigation?, Who should conduct my organization’s internal investigation and what role should company leadership play in the process?, What document preservation obligations exist prior to and during an investigation?, What are the legal industry’s recommended “best practices” for conducting employee interviews during investigations?, During an investigation, under what circumstances can an organization claim privilege over communications between its counsel and its employees? and What are the implications of an organization’s decision to “cooperate” with a government agency?

3:00 PM Change is Coming to Business Bankruptcy

The world and the nature of business has markedly changed since the Bankruptcy Code was first enacted in 1978. Chapter 11, however, has remained substantially the same during this time. Recognizing this fact, the American Bankruptcy Institute organized a Commission to study the reform of Chapter 11, which issued its Final Report and Recommendations in late 2014. Additionally, in recent years, several states have undertaken their own modernization efforts of their antiquated insolvency laws. This session will highlight several of the proposed reforms being recommended as well as other modernization efforts in various states and how the same may ultimately impact the business bankruptcy practice.
