The Kansas Bar Association is teaming up with CLE NetShows to bring you a month of comedic legal ethics seminars featuring Sean Carter, everyone's favorite humorist at law. Carter, a Harvard Law School graduate, has been dubbed "America's funniest lawyer" and lawyers from over 350 bar associations and law firms in 40 states agree.

Yelp, I've Fallen for Social Media and I Can't Linkedout!: The Ethical Pitfalls of Social Media

In this presentation, Sean Carter explores the ethical pitfalls that might ensnare lawyers in their use of social media. Citing specific disciplinary cases and ethics opinions, Carter demonstrates how seemingly innocuous acts can lead to violations of the Rules of Professional Conduct. And, perhaps most importantly, Carter will provide suggestions for how to properly use this powerful tool within the confines of our ethical boundaries.

In particular, Carter will raise the question of whether legal competence requires a lawyer to use social media. From there, Carter will delve into the specific ethical issues raised by its use, including:

  1. Confidentiality
  2. Ex parte communications
  3. Communications with represented and unrepresented persons
  4. Fraudulent investigations
  5. Public statements about proceedings
  6. Marketing violations
